Handwritten notes regarding the case of J.R. against J.H.F., dated 30 October 1858. The parties entered into an agreement whereby J.R. sold and J.H.F. purchased a tract of land called Oregon Hills in Rockingham County, North Carolina. The first payment was due on January 1, 1859, with the balance due four months thereafter. The contract also included a provision for a penalty of $500 in the event of breach by either party. In October it became clear to J.R. that J.H.F. would not make the first payment due in January because of some dissatisfaction with the deed. J.R. is seeking to sue for anticipatory breach and recover the $500 penalty stipulated by the contract.
