Abstract: Pursuer Robert Playfair, a lawyer, sought to recover the expenses he incurred while defending Robert Bisset. Bisset claimed that he never authorized Playfair to act as his attorney in the underlying dispute. Finding that both parties had acted in bad faith, the Lord Ordinary declined to award expenses, and Playfair petitioned for review.
